This Privacy Statement sets forth the information gathering, use, and dissemination practices of Ulticom, Inc., any of its affiliates and subsidiary companies ("Ulticom") in connection with the Internet websites located at www.ulticom.com and any related sites, including but not limited to my.ulticom.com (the "Sites").  Ulticom provides this Privacy Statement to advise you of Ulticom’s internet privacy procedures and the choices you may make about the way any of your information is collected by Ulticom online and how that information may be used by Ulticom.  This Privacy Statement addresses Ulticom's practices regarding information collected only directly through or from the Sites - it does not address or govern any information gathering, use, or dissemination practices related to information collected other than directly through or from the Sites, including, without limitation, from or via telephone, facsimile, postal mail, personal delivery, or other or additional offline means or media.  Moreover, the Ulticom Sites may be referenced by or be accessible from links contained on other non-Ulticom websites, including websites of third parties.  Ulticom has not investigated, and is not responsible for the privacy practices or content of any of those third party websites.  The policies and procedures of any of those websites may be different from the policies and procedures of the Ulticom Sites.  Ulticom strongly recommends that you investigate and review the privacy practices of any third party websites that you may use or reference.

1. Collection of Personal Information from Site Visitors

Ulticom may collect or track (1) the e-mail addresses of visitors that communicate with Ulticom via e-mail, (2) information knowingly provided by any visitor in online forms, registration forms, surveys, e-mail, the "Contact Us" section of the Site, and other online avenues (including, but not limited to, demographic, business profile, and personal profile data), (3) the home server domain names, e-mail addresses, type of client computer, files downloaded, search engine used, operating system, and type of Web browser of visitors to any of the Sites, and (4) aggregate and user-specific information regarding which pages of the Sites that visitors access.

 

Ulticom may also place Internet "cookies" on visitors' computer(s). Internet cookies save data about individual visitors, such as the visitor's name, password, user-name, shopping cart, screen preferences, and the pages of Ulticom Sites that are viewed by the visitor. When the visitor revisits the Site, Ulticom may recognize the visitor through reference to the Internet cookie and customize the visitor's experience accordingly.  Cookies act as unique identifiers for your computer, but cannot be used to identify any individual.  Visitors may decline Internet cookies, if any, by using the appropriate feature of their Web client software, if available.

 

When a visitor conducts or requests a search within any Ulticom Site, Ulticom may record and maintain information identifying the visitor and / or linking the visitor to the search performed. Ulticom may also record limited information for every search request and use that information to solve technical problems with the services available directly or indirectly in connection with any of the Sites and to calculate overall usage statistics.

 

2. Use of Personal Data Collected

Ulticom collects and uses personal information to better understand your needs and interests and to provide you with better service.  Personal data collected by Ulticom may be used by Ulticom for many reasons, including for example, for editorial and feedback purposes, for product development, for content improvement, for fulfillment of a requested transaction or recordkeeping, for marketing and promotional purposes, for a statistical analysis of users' behavior, or to customize the content and layout of any of the Sites. Aggregate data on visitors' computer(s) may be used for internal purposes, and individually identifying information, such as names, postal and e-mail addresses, telephone numbers, and other personal information which visitors voluntarily provide to Ulticom may be added to Ulticom's databases and used for future calls and mailings regarding any updates to any of the Sites, to new products and services, and relating to any upcoming events.

 

3. Disclosure of Personal Data to Third Parties

Aggregate data regarding visitors' computer(s) and individually identifying information, such as names, postal and e-mail addresses, and phone numbers, may be disclosed or distributed to another party with which Ulticom enters or reasonably may enter into a corporate transaction, such as, for example, a merger, consolidation, acquisition, or asset purchase, or to a third party pursuant to a subpoena, court order, or other form of legal process, in response to a request by or on behalf of any local, state, federal, or other government agency, department, or other governmental body, whether or not pursuant to a subpoena, court order, or other form of legal process, or if determined by Ulticom in its sole judgment that such disclosure or distribution is appropriate to protect the life, health, or property of Ulticom or any other person or entity.

 

While Ulticom may undertake efforts to see that any third party to which Ulticom shares, rents, sells, or otherwise discloses personal data is under a contractual obligation to use the personal data solely for the purposes for which the data was disclosed, such third parties are independent entities over which Ulticom exercises no particular or specific control. Ulticom is not responsible for, and will not be liable for, the conduct, actions, omissions, or information handling or dissemination practices of any third party.

 

The Sites may contain links to other Internet websites or advertisements for or placed by third parties. Ulticom is not responsible for the privacy practices or procedures of any such third party websites, advertisers, or third parties, or for the content of any such sites or advertisements. It is possible that these links or advertisements may, in turn, be used by third parties or others to collect personal or other information about Site visitors. It is solely the visitors' obligation to review and understand the privacy practices and policies of these other Web Sites and of these advertisers and third parties.

 

4. Ulticom Security Measures

Ulticom has implemented security features that are designed to prevent the unauthorized release of or access to retained personal information.  Ulticom protects its various databases with physical, electronic, technical and procedural measures, and Ulticom restricts access to any personal information by unauthorized persons or entities.  Ulticom uses Secure Sockets Layer (“SSL”) Technology to protect personal information maintained on or transmitted to or from Ulticom systems.  SSL Technology is the electronic commerce standard for securing information as it travels over the Internet.  Through your use of any of the Ulticom Sites, you expressly acknowledge that the confidentiality of any communication or material transmitted to or from Ulticom via the Ulticom Sites or via e-mail cannot be and is not guaranteed. Accordingly, Ulticom is not responsible for the security of any information transmitted via the Internet to or from Ulticom. Instead of communicating with Ulticom via e-mail or the Internet, visitors can contact Ulticom as provided in Section 8 below.

 

5. Opt-Out Right

Except as may be necessary for Ulticom to provide the services, information, or products requested by a visitor, the visitor may opt out of having his or her personally identifiable information, which has been voluntarily provided to Ulticom through an account registration, customer order, or electronic news or information subscription, prospectively retained by Ulticom, used by Ulticom for secondary purposes, or disclosed by Ulticom to third parties by contacting Ulticom via postal mail, e-mail, or telephone at the addresses provided in Section 8 below.

 

6. Access to and Ability to Correct Personal Data

Upon a visitor's request via postal mail, e-mail, or telephone, Ulticom will provide to the visitor a summary of any personally identifiable information retained by Ulticom regarding the visitor, which information has been voluntarily provided by the visitor to Ulticom through an account registration, customer order, or electronic news or information subscription. A visitor may modify, correct, change or update their personally identifiable information by contacting Ulticom via postal mail, e-mail, or telephone at the addresses or numbers provided in Section 8 below.

 

7. Right to Change Privacy Statement

Ulticom may update or change this Privacy Statement at any time. Notice of any new or revised Privacy Statement, as well as the location of the new or revised statement, will be posted on the Site for at least sixty (60) days after any such update or change.  Ulticom encourages you, and you acknowledge that it is your obligation to review and confirm your acceptance of any updates or changes to the Privacy Statement since your last previous use or visit to any Ulticom Sites.
